The CLARITY Act failed because of partisan gridlock. The SEC's proposal is a unilateral move that will likely be contested by members of Congress who want to retain legislative control. The CFTC has also expressed interest in regulating crypto. The proposal may trigger a turf war between the SEC and CFTC, further delaying clarity. Another blind spot: the market's reaction is based on hope, not data. The proposal remains unpublished. The rally is a speculative bet on the content. I have seen this pattern before. In the FTX collapse, markets rallied on news of a bailout that never came. The same could happen here. The proposal could be released to the public within weeks, and if it contains strict provisions, the market will reverse. Moreover, the proposal's success depends on enforcement.
